Surgeons Warn Of Problems With Zimmer Knee Product (Fox Business: Health Care) - Mar 11, 2010

Berger stressed that these aren't errors in technique and that the issue "was related to the implant design itself.". Deutsche Bank analyst Tao Levy said this could be a "potentially significant issue" for Zimmer and also a positive for rivals Stryker Corp ( SYK ) and Johnson & Johnson ( JNJ ). The orthopedics conference has also featured scrutiny of so called "metal on metal" hip implants, which use metal surfaces on both the ball and socket portions, amid some safety concerns. These aren't new concerns to surgeons, but they have been aired out in recent news reports, and analysts indicated Thursday that doctors will ramp back on using these parts. The metal hips are popular for perceived durability, but doctors also have hips with ceramic and plastic surfaces at their disposal.

Massachusetts joins kickback suit against J&J (Fierce Pharma) - Mar 11, 2010

The Massachusetts attorney general joined that federal lawsuit accusing Johnson & Johnson of paying kickbacks to push the antipsychotic Risperdal and other drugs into nursing homes. AG Martha Coakley didn't stop there; however, her office is also investigating other companies that market antipsychotics to nursing homes in the state. . At issue is whether drug companies are touting antipsychotic drugs for unapproved uses, such as dementia.

Some newly released court documents suggest that Johnson & Johnson was leaning heavily on the geriatric market to boost sales of its atypical antipsychotic Risperdal at a time when federal regulators were warning the company against claiming the drug was safe and effective in elderly patients, Bloomberg reports. . The documents, made public after Bloomberg asked a judge to unseal them, show that J&J was pushing to expand use of the drug beyond its schizophrenia indication. "Schizophrenia represents only 35 percent" of antipsychotic scrips, one executive at J&J subsidiary Janssen wrote in an internal report.

Risperdal global sales peaked at $4.5 billion in 2007, declining after the company lost patent protection, company filings showed."We don't view it as a problem for J&J at this moment," said Les Funtleyder , an analyst with Miller Tabak & Co in New York, who recommends buying J&J shares and doesn't own any. "The one exception, and we haven't really seen this, is when there's a sort of systemic problem. somebody at the top says, ‘You shall market off label no matter what the law says.'". Four J&J competitors that also make atypical antipsychotics paid a total of more than $2.5 billion to resolve government claims they marketed medicines for off label uses.

The lawsuit also alleged J&J hid the payments from Medicaid to avoid reporting a ‘best price' that would have triggered paying rebates to Medicaid (The US Department of Justice recently reached a settlement with Omnicare) One exhibited contained in the lawsuit appears to raise the issue of off label promotion

J&J Sales Rep Denied Overtime Pay By Court (Pharmalot) - Feb 03, 2010

An appeals court upheld a decision in favor of Johnson & Johnson in a lawsuit alleging the drugmaker misclassified sales reps as exempt from overtime pay. The US Court of Appeals for the Third Circuit ruled that Patty Lee Smith, a former sales representative for J&J's Ortho McNeil unit, wasn't due overtime because she wasn't exempt from the overtime provisions of the Fair Labor Standards Act The FLSA's overtime compensation requirement doesn't apply to employees who work as outside salespeople, but the law does require employers to pay overtime for hours worked beyond 40 hours a week, unless a FLSA exemption applies

A patent dispute regarding Boston Scientific ( BSX ) cardiac stents dating back to 2003 has finally come to a close with Boston Scientific to pay Johnson & Johnson ( JNJ ) $1.725 billion in two tranches. This major settlement is in addition to a separate patent settlement last September in which BSX must pay $716 million to JNJ The infringement cases are not all one way, as back in Johnson & Johnson infringed on some of BSX's stent technology
